1. Scope and Purpose of the General Store Conditions
1.1 These General Conditions are intended, together with the order form and other elements referred to therein, to regulate the terms and conditions under which the Online Store Service – Montado do Freixo do Meio (“Service” or “Store”) will be provided by Sociedade Agrícola do Freixo do Meio, Lda., headquartered at Herdade do Freixo do Meio, 7050-704 Foros de Vale de Figueira, registered under the corporate taxpayer and company registration number 503593320, with a share capital of €50,000, hereinafter referred to as “Store Conditions.” Contact details: Tel. +351 266877136 | Email: geral@herdadedofreixodomeio.pt
1.2 The Service consists of providing access to the Online Store through the address https://freixodomeio.pt/, which, in addition to offering information about a set of products and/or services, allows the User to order the products disclosed therein electronically, under the terms and conditions described here.
1.3 Product orders must be placed by Users aged 18 or over (minors must have authorization from their legal representatives). The elements and information provided by the User will have full legal effects, and the User acknowledges electronic purchases and cannot claim the lack of a signature to avoid fulfilling the obligations assumed.
2. Product and Content Information
2.1 Sociedade Agrícola do Freixo do Meio, Lda. will make every effort to ensure that the information presented does not contain typographical errors, and any such errors will be promptly corrected whenever detected. If you purchase a product with characteristics different from those shown online, you have the right to withdraw from the purchase contract under applicable legal terms (right of withdrawal – see point 7).
2.2 Sociedade Agrícola do Freixo do Meio, Lda. will make every effort to supply all the ordered products and/or services, but it is possible that, in some cases and due to causes beyond its control, such as human error or incidents in computer systems, it may not be possible to provide some of the requested products or services. If any product or service is unavailable after ordering, you will be informed by email or telephone and may choose to cancel the order and receive a refund.
2.3 All information regarding price, products, specifications, promotional actions, and services may be changed at any time.
2.4 Product delivery will be made within a maximum of 30 days unless expressly indicated otherwise at the time of order.
2.5 Visits and lunches are intangible products subject to a minimum number of participants. Visits require a minimum of 7 people. If this number is not reached, the customer will be notified the day before and may opt for a refund, rescheduling, or exchange for another available activity. Meals may also be changed or canceled for logistical reasons, with the same options for refund or rescheduling.
3. Responsibilities
3.1 All products and services sold in the Online Store – Montado do Freixo do Meio comply with Portuguese law.
3.2 The Store has appropriate security levels; however, Sociedade Agrícola do Freixo do Meio, Lda. will not be responsible for any damages suffered by the User and/or third parties due to delays, interruptions, errors, or suspensions in communications caused by factors beyond its control, such as deficiencies or failures caused by communication networks or services provided by third parties, computer systems, modems, connection software, or any computer viruses or resulting from file downloads containing viruses or other harmful properties. If, due to access errors to the Online Store website, service provision is impossible, Sociedade Agrícola do Freixo do Meio, Lda. will not be liable for any resulting damages.
3.3 Data and information queries within the scope of this Service are presumed to be made by the User. Sociedade Agrícola do Freixo do Meio, Lda. declines any responsibility arising from abusive or fraudulent use of the information obtained.
3.4 Sociedade Agrícola do Freixo do Meio, Lda. shall not be held liable for any losses or damages caused by improper use of the Service that is not directly attributable to it through willful misconduct or gross negligence.
3.5 Sociedade Agrícola do Freixo do Meio, Lda. is not responsible for losses or damages resulting from non-compliance or defective compliance with the Service when such is not directly or indirectly attributable to it through willful misconduct or gross negligence, particularly (i) errors, omissions, or inaccuracies in the information provided through the Service; (ii) damages caused by the User’s or third parties’ fault, including intellectual property violations; (iii) non-compliance resulting from compliance with judicial or administrative decisions; or (iv) non-compliance resulting from force majeure situations, i.e., extraordinary or unforeseeable events beyond the control of Sociedade Agrícola do Freixo do Meio, Lda., such as fires, power outages, explosions, wars, riots, civil insurrections, governmental decisions, strikes, earthquakes, floods, or other natural disasters or events.
3.6 Sociedade Agrícola do Freixo do Meio, Lda. does not guarantee that: i) the Service will be uninterrupted, secure, error-free, or continuously available; ii) the quality of any product, service, information, or other material purchased or obtained through the Service will meet the User’s expectations; iii) any material obtained through the use of the Service is used at the User’s own risk, with the User solely responsible for any damage caused to their system or loss of data; iv) no advice or information, whether oral or written, obtained from or through the Service will create any warranty not expressly stated in these General Conditions.
3.7 The User accepts that Sociedade Agrícola do Freixo do Meio, Lda. shall not be liable for any damage, including loss of profits, data, content, or other losses (even if previously warned of the possibility of such damages), resulting from: i) the use or inability to use the Service; ii) the difficulty in obtaining substitutes for goods/services; iii) unauthorized access or modification of personal databases.
4. Consumer Obligations
4.1 The User undertakes to: i) Provide accurate personal data and addresses; ii) Not use false identities; iii) Respect the order limits imposed.
4.2 If any of the provided data is incorrect or insufficient, and for that reason there is a delay or impossibility in processing the order or potential non-delivery, the responsibility lies with the User. Sociedade Agrícola do Freixo do Meio, Lda. disclaims any liability. If the consumer violates any of these obligations, Sociedade Agrícola do Freixo do Meio, Lda. reserves the right to cancel future purchases, block access to the store, cancel the supply of any other services simultaneously provided by Sociedade Agrícola do Freixo do Meio, Lda. to the same User, and deny the User future access to any services provided by Sociedade Agrícola do Freixo do Meio, Lda.
4.3 The use of purchased products and services for commercial purposes, particularly for resale, is strictly prohibited.
5. Privacy and Personal Data Protection
5.1 Sociedade Agrícola do Freixo do Meio, Lda. guarantees the confidentiality of all data provided by Users.
5.2 Personal data identified in the order form as mandatory are essential for the provision of the Service by Sociedade Agrícola do Freixo do Meio, Lda. Omission or inaccuracy of the data provided by the User is their sole responsibility and may result in the refusal to provide the Service.
5.3 The User’s personal data will be processed and stored electronically and are intended for use by Sociedade Agrícola do Freixo do Meio, Lda. within the contractual and/or commercial relationship with the User and, if authorized by the User, for marketing purposes via our Newsletter.
5.4 Under applicable legislation, the User has the right to access, rectify, and update their personal data at no additional cost, either directly or by written request, as well as the right to object to their use for the purposes mentioned in the previous paragraph. Requests must be addressed to the data controller, Sociedade Agrícola do Freixo do Meio, Lda.
5.5 The Internet is an open network, and the User’s personal data, other personal information, and all content hosted on the Service may circulate on the network without security conditions, being potentially accessible and used by unauthorized third parties. Sociedade Agrícola do Freixo do Meio, Lda. cannot be held responsible for such access and/or use.
6. Order Cancellation
6.1 At the User’s request The User may cancel their order by contacting Sociedade Agrícola do Freixo do Meio, Lda. via telephone or email and providing the order number. The request will be accepted provided the order has not yet been processed. After processing, Sociedade Agrícola do Freixo do Meio, Lda. will attempt delivery, but the User may choose not to accept it. The User must provide the following information for cancellation: a) Order number; b) Taxpayer number (NIF) and delivery address used when placing the order.
6.2 At the discretion of Sociedade Agrícola do Freixo do Meio, Lda. Sociedade Agrícola do Freixo do Meio, Lda. reserves the right not to process orders when there are inconsistencies in the personal data provided or if misconduct by the buyer is observed. Sociedade Agrícola do Freixo do Meio, Lda. also reserves the right not to process any order or refund if pricing and/or product characteristics are incorrect due to technical problems or errors beyond its control.
7. CANCELLATION AND RETURNS (Right of Withdrawal)
7.1 The cancellation or return process for services purchased through the Store is handled on a case-by-case basis by Sociedade Agrícola do Freixo do Meio, Lda. Requests must be sent in writing to geral@herdadedofreixodomeio.pt up to 2 days before the service is provided. Cancellation instructions and refund conditions will be communicated by the same means.
7.2 If a refund is approved, it will be issued via bank transfer.
8. Intellectual Property
8.1 The Store is a registered website and the Service provided through it is the responsibility of Sociedade Agrícola do Freixo do Meio, Lda.
8.2 The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property, and other applicable legal provisions.
8.3 The User acknowledges that any content included in advertisements, highlights, promotions, or any mention of a sponsor or advertiser is protected by intellectual property laws, and such content may only be used with express authorization from the respective owners.
8.4 The User agrees to fully respect the rights referred to above and, in particular, to refrain from performing any acts that may violate the law or those rights, such as reproduction, commercialization, transmission, or public disclosure of such content without prior authorization.
9. Service Security Conditions
9.1 The User agrees to comply with all applicable legal provisions and not to promote or practice any unlawful acts, including unsolicited communications (spamming), in violation of personal data and advertising laws. Failure to do so may result in suspension or termination of the Service as provided in point 14.
9.2 The User expressly acknowledges and accepts that the IP Network is a public electronic communication network subject to overloading, and Sociedade Agrícola do Freixo do Meio, Lda. does not guarantee uninterrupted service, loss-free information, or delay-free performance.
9.3 Sociedade Agrícola do Freixo do Meio, Lda. does not guarantee service in cases of unpredictable system overload or force majeure events.
9.4 In the event of service interruption due to such situations, Sociedade Agrícola do Freixo do Meio, Lda. will restore normal operation as soon as possible.
10. Service Suspension and Deactivation
10.1 Sociedade Agrícola do Freixo do Meio, Lda. may, at its sole discretion and without prior or subsequent notice, discontinue the Service or any part of it to one or all Users.
10.2 Sociedade Agrícola do Freixo do Meio, Lda. also reserves the right to suspend or terminate access to the Service in the following cases: a) Failure by the User to comply with the conditions outlined in point 4 and other terms herein; b) Discontinuation of access to the Store, with prior notice at least 15 days in advance.
10.3 Suspension or termination of the Service under the previous terms does not entitle the User or third parties to any compensation. Sociedade Agrícola do Freixo do Meio, Lda. shall not be held responsible for any consequences arising from the suspension or cancellation of the Service.
10.4 In such cases, Sociedade Agrícola do Freixo do Meio, Lda. will inform the User in advance so they may, if desired, save the content from their order history within 3 (three) business days from the email notification or publication on the main Service page.
11. Communications
11.1 Without prejudice to other communication methods provided in these Terms and Conditions, notifications to the User regarding the Service, including potential changes, may be sent to the User’s email address, via SMS, or by phone.
11.2 The User agrees to receive all communications and/or notifications related to the Online Store at the address, phone number, or email address provided in the ordering process.
11.3 The User may opt out of receiving such communications at any time by using the contact form or the “Unsubscribe” option included in every Newsletter.
12. Technical Settings
12.1 Notwithstanding the following clause, Sociedade Agrícola do Freixo do Meio, Lda. may change the Service and/or its technical conditions and usage rules, providing the User with at least 15 (fifteen) days’ notice.
12.2 The latest version of these General Conditions and their annexes will always be available at https://freixodomeio.pt/.
13. Network Settings
13.1 Whenever deemed necessary or appropriate to improve browsing experience and/or connectivity, Sociedade Agrícola do Freixo do Meio, Lda. may remotely reconfigure network settings.
13.2 Given the innovative nature of the Service and its potential technological evolution, Sociedade Agrícola do Freixo do Meio, Lda. may alter technical settings to adapt to future developments.
13.3 Sociedade Agrícola do Freixo do Meio, Lda. does not guarantee upgrades or improvements to the Service.
13.4 Some upgrades or new features may be available only upon payment or the User’s acceptance of specific usage conditions.
14. Complaints
14.1 The User may submit any contractual disputes to legally recognized arbitration and mediation mechanisms or lodge complaints directly with Sociedade Agrícola do Freixo do Meio, Lda. for actions or omissions that violate applicable laws on goods purchasing.

14.3 Complaints must be submitted within 30 (thirty) days from the date the User becomes aware of the facts and will be registered in the information systems of Sociedade Agrícola do Freixo do Meio, Lda., which will decide and respond within 30 (thirty) days of receipt.
15. Applicable Law
The Contract is governed by Portuguese law.
